When a patient comes to a medical facility seeking help, they expect that they will be treated with care and attention. When the opposite happens, it can be difficult to know what to do. People all over the country have been subjected to misdiagnosis, failure to diagnose, blatant errors, and equipment failures. A lesser known issue in these types of situations is a lack of supervision for patients who are in the care of a hospital or other medical facility. When the member of the medical staff fails to properly monitor the patient, their condition could become worse or they could fail to catch a side effect to a treatment or a reaction to a medication. In some cases, the patient may be permanently harmed or even killed. What makes these cases so tragic is the fact that they could have been avoided had the patient been properly supervised.
The negligent care of medical staff can be grounds for a medical malpractice lawsuit. In such cases, it’s best to speak to experienced medical malpractice lawyers for legal advice.
An example of what a lack of supervision can lead to involves the death of a ten-year-old girl. She had fallen and injured her back, so her parents took her to the local emergency room. X-rays were taken of her back, but no apparent spinal damage was discovered. While in the emergency room, she developed a fever. In a urinalysis test, traces of blood were found, but others tests showed no red flags. When the fever reduced to a safe level, the girl was discharged from the hospital, even though she was still unable to walk. After three days, when the pain in her legs kept increasing, her parents took her to a different emergency room, where she died. In the autopsy, it was discovered that the child died of blood poisoning. Had the first hospital performed a simple blood test while she was in their care, they could have caught and treated it with antibiotics.
The legal team of The Law Offices of Joseph Lichtenstein can help determine whether or not proper medical protocol was followed. If failure to follow protocol is determined, you may be able to file a medical malpractice lawsuit against the hospital.
In Nursing Homes
In nursing homes, a lack of supervision can be more than medical-related. Many elderly loved ones suffer from dementia, Alzheimer’s disease, and other mental illnesses. Without attentive supervision, the individual could wander away and become injured. This is especially dangerous when the weather is extremely cold or hot or if they wandered away in the middle of the night. Another hazard which a lack of supervision could fail to stop is choking. When they are not given the proper food or their feeding tubes are not checked, the result can be asphyxiation and death. The elderly are also more susceptible to falls and so need more supervision. This could be a fall on stairs, out of bed, or while outside. Regardless of where it is, staff members need to be aware of this potential for serious injury and make sure they are giving their patients the proper care and attention.
In Psychiatric Units
Many patients who are admitted to psychiatric hospitals or units require round-the-clock supervision due to the potential they may harm themselves or another patient. When medical staff fails in this regards, the consequences can be tragic. As there are over 1,800 inpatient suicides every year, it is important that everything is done to protect these patients. Not only is there the potential for suicide, but as psychiatric patients also are on different prescriptive medications, there is also the risk of an allergic reaction to the drugs as well. In a recent case, a patient was admitted to a hospital after overdosing on Tylenol. As she had already attempted to take her own life, she was supposed to be supervised carefully. At 6.30 a.m., the nurse found that the screen of the window had been kicked out. When she returned again, the patient had jumped from her seventh story window.
